Who Do the Rules Apply To?
The EOLV Rules cover a wide range of stakeholders:
- Producers: Vehicle manufacturers and importers.
- Registered Owners: Individuals or entities owning vehicles.
- Bulk Consumers: Organizations owning 100+ vehicles.
- Registered Vehicle Scrapping Facilities (RVSFs): Authorized scrapping centers.
- Collection Centers & Testing Stations: Facilities for vehicle storage and fitness testing.
Excluded entities include agricultural machinery (tractors, trailers, etc.) and materials covered under specific waste management rules like batteries, tyres, and e-waste.
Key Responsibilities
Producers:
- Extended Producer Responsibility (EPR): Achieve scrapping targets and ensure ELVs are processed at RVSFs.
- Customer Engagement: Offer buy-back schemes and deposit refunds.
- Registration & Reporting: Register with CPCB and submit annual reports.
- Awareness: Educate consumers on safe ELV disposal.
Registered Owners & Bulk Consumers:
- Test vehicles for fitness and dispose of ELVs at registered facilities within 180 days.
- Bulk consumers must register with the CPCB and submit annual returns.
Collection Centers & Testing Stations:
- Safely store ELVs and ensure their transportation to RVSFs.
- Testing stations must report unfit vehicles to a central portal.
RVSFs:
- Pollution Control: Remove hazardous materials.
- Recycling: Process materials like metals and plastics responsibly.
- Record Keeping: Maintain detailed logs of all ELVs processed.
- File quarterly returns with state authorities.
Accountability Through Environmental Compensation
Non-compliance by producers, RVSFs, or bulk consumers results in penalties. Funds collected as compensation are used for environmental restoration. Partial reimbursements are offered for timely compliance within three years.
Meeting EPR Targets
Producers must meet scrapping targets by recycling materials, including steel and tyres, through RVSFs. Compliance is tracked via a centralized portal.
